Domestic Violence – Assault
Assault is defined in N.J.S.A. 2C:12-1. Many people might be surprised at what actually constitutes an assault in the state of New Jersey. First, there are two separate types of assault, simple and aggravated.
Simple Assault occurs if a person attempts to cause bodily injury to another, negligently causes bodily injury with a deadly weapon or attempts to put another person in fear of imminent serous bodily injury. The important thing to remember with simple assault is that you can be found guilty even if you only attempt to cause harm. The actual physical harm does not even have to happen.
Aggravated assault is more serious and often involves weapons and extreme indifference for human life. This also includes reckless, negligently or purposeful acts by an abuser. Please contact a professional or the police for help if you are being subjected to these types of dangers.
